この利用規約（以下「本規約」）は、株式会社フランリベル（以下「当社」）が提供するアプリ「プニッチェ - こどもの習慣化支援・お手伝い」（以下「本アプリ」）の利用条件を定めるものです。本アプリを利用した時点で、本規約に同意したものとみなします。本規約に定めのない事項は、Apple の標準使用許諾契約（Standard EULA）に従います。

1. 本アプリの内容

本アプリは、お子様の毎日の「やること」を記録し、続けた日数に応じて相棒のキャラクターが育つ、習慣づくりのアプリです。記録や相棒の育ち方は、本アプリの中の楽しみとして提供するもので、お子様の成長や学習の成果を保証するものではありません。

2. 保護者の方へ

  • 本アプリはお子様の利用を想定しています。設定・購入・家族への招待などは、保護者の方が「おうちのひと」（暗証番号と保護者向けの確認の内側）から行ってください。
  • 暗証番号の管理は、保護者の方の責任で行ってください。

3. 有料の機能

  • プニッチェプレミアム（買い切り）：一度の購入で、家族のプロフィールや追加の背景・アクセサリーなどが使えるようになります。
  • プニッチェ プラス（自動更新サブスクリプション）：家族の iPhone・iPad のあいだで記録を同期する機能です。月額プランと年額プランがあります。価格はアプリ内と App Store に表示される金額です。年額プランには、初めての方向けの無料体験がある場合があります。
  • 購入・解約・支払いは、Apple の App Store を通じて行われます。
  • サブスクリプションは、期間終了の24時間前までに解約しない限り、同じ期間・同じ料金で自動的に更新されます。料金は、購入の確定時と更新時に Apple ID に請求されます。
  • 無料体験期間中に解約した場合、料金はかかりません。無料体験の終了の24時間前までに解約しない場合は、有料のサブスクリプションに移ります。
  • 解約やプランの変更は、iPhone の「設定」→ 名前 →「サブスクリプション」から、いつでも行えます。本アプリの中で家族の同期をおわらせても、サブスクリプションは解約されません。
  • プニッチェ プラスは、Apple のファミリー共有に対応しています。また、家族の同期に招待された方は、追加の料金なしで同期を利用できます。
  • 返金は Apple の定めに従います。

4. 家族の同期（プニッチェ プラス）について

  • 家族の同期を使うと、本アプリの記録は、家族を作った方の iCloud（Apple のサービス）に保存され、招待された方と共有されます。当社はこの記録を閲覧できません。iCloud の利用には、Apple の利用規約が適用されます。
  • 家族への招待は、相手の Apple ID のメールアドレスまたは電話番号を入れて行います。招待する相手は、ご家族など信頼できる方に限ってください。
  • 家族を作った方が家族の同期をおわらせると、iCloud 上の家族の記録は削除され、参加している方の同期もとまります。それぞれの端末の記録は残ります。
  • 同期には、インターネットへの接続と iCloud へのサインインが必要です。通信の状況や iCloud の空き容量などにより、反映が遅れたり、同期できなかったりすることがあります。
  • 家族を作った方の iCloud の空き容量が不足すると、同期できなくなることがあります。

5. 禁止事項

  • 法令または公序良俗に反する行為
  • 本アプリの改変、解析（逆コンパイル等）、不正な利用
  • 他人になりすまして家族に参加する行為、他人の記録を無断で取得する行為

6. 免責

  • 当社は、本アプリの利用により利用者に生じた損害（データの消失、同期の不具合、端末の不具合、その他の損害を含みます）について、当社の故意または重大な過失による場合を除き、責任を負いません。大切な記録は「データの ひきつぎ（バックアップ）」で保存しておくことをおすすめします。
  • 当社の過失（重大な過失を除きます）により利用者に損害が生じた場合でも、当社が責任を負う範囲は、通常生じうる直接の損害に限られ、その額は、損害の原因となった事実が生じた月に利用者が当社に支払った本アプリの利用料金の額を上限とします。
  • 当社は、本アプリが利用者の特定の目的に適合すること、すべての端末・OS で正常に動作すること、不具合がないことを保証しません。
  • iCloud・App Store など Apple のサービスの停止や仕様の変更により、本アプリの機能が使えなくなる場合があります。

7. 本規約の変更

当社は、必要に応じて本規約を変更することがあります。変更後の本規約は、本ページに掲載した時点から効力を生じます。

8. 準拠法・管轄

本規約は日本法に準拠します。本アプリに関して紛争が生じた場合は、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

These Terms of Use (the "Terms") set out the conditions for using "Punicchee" (the "App") provided by FranLiber Inc. ("we"). By using the App, you agree to these Terms. Matters not covered here are governed by Apple's Standard EULA.

1. About the App

The App is a habit-building app that records a child's daily tasks and grows a buddy character as the child keeps going. The records and the buddy are provided for fun within the App; we do not guarantee any growth or learning outcome.

2. For parents and guardians

  • The App is designed for children. Settings, purchases, and family invitations should be handled by a parent or guardian from the parent area (behind the PIN and a parental check).
  • Parents and guardians are responsible for managing the PIN.

3. Paid features

  • Punicchee Premium (one-time purchase): unlocks family profiles, extra backgrounds, accessories, and more with a single purchase.
  • Punicchee Plus (auto-renewable subscription): syncs records between your family's iPhones and iPads. Monthly and yearly plans are available. Prices are as shown in the App and on the App Store. The yearly plan may include a free trial for first-time subscribers.
  • Purchases, cancellations, and payments are handled through Apple's App Store.
  • Subscriptions automatically renew for the same period and price unless canceled at least 24 hours before the end of the current period. Payment is charged to your Apple ID at confirmation of purchase and at each renewal.
  • If you cancel during a free trial, you will not be charged. If you do not cancel at least 24 hours before the trial ends, it converts to a paid subscription.
  • You can cancel or change your plan at any time in Settings → your name → Subscriptions. Ending family sync in the App does not cancel your subscription.
  • Punicchee Plus supports Apple Family Sharing. People invited to your family sync can use it at no additional charge.
  • Refunds are handled under Apple's policies.

4. Family sync (Punicchee Plus)

  • When you use family sync, the App's records are stored in the iCloud account (an Apple service) of the person who created the family and shared with the people they invite. We cannot view these records. Apple's terms apply to your use of iCloud.
  • You invite someone by entering the email address or phone number of their Apple ID. Please invite only family members or other people you trust.
  • If the person who created the family ends family sync, the family records in iCloud are deleted and syncing stops for everyone. Records on each device remain.
  • Syncing requires an internet connection and being signed in to iCloud. Depending on network conditions and available iCloud storage, updates may be delayed or may not sync.
  • If the family creator's iCloud storage is full, syncing may stop.

5. Prohibited conduct

  • Conduct that violates laws or public order and morals
  • Modifying, reverse engineering, or misusing the App
  • Joining a family by impersonating someone else, or obtaining others' records without permission

6. Disclaimer

  • Except in cases of our willful misconduct or gross negligence, we are not liable for any damage arising from your use of the App, including loss of data, sync problems, or device problems. We recommend saving important records with the "data transfer (backup)" feature.
  • Where we are liable due to our negligence (other than gross negligence), our liability is limited to direct damages that would ordinarily arise, up to the amount you paid us for the App in the month in which the cause of the damage occurred.
  • We do not guarantee that the App will fit your particular purpose, work properly on every device and OS version, or be free of defects.
  • Features of the App may become unavailable due to outages or changes in Apple services such as iCloud and the App Store.

7. Changes

We may change these Terms as needed. Updated Terms take effect when posted on this page.

8. Governing law

These Terms are governed by the laws of Japan. The Tokyo District Court shall have exclusive jurisdiction in the first instance over any dispute relating to the App.
